An-Nisa 4:8

“And when [other] relatives and orphans and the needy are present at the [time of] division, then provide for them [something] out of it [i.e., the estate] and speak to them words of appropriate kindness.”

Saheeh International

Essence

When an estate is divided before those with no share, give them something from it and a kind word: no one should leave empty.

A reflection

Watching others take

A solicitor reads out a will in a small office. Children, grandchildren, a brother. At the back sits the woman who cared for the deceased for six years, through every night of his last illness. Her name is not mentioned. The family files out past her, discussing dates.

The ayah is written for that room. When the division is attended by relatives, orphans and the needy, those with no share. One classical commentator describes what goes on inside them. They watch this one take, and that one take, and that one take. They have no hope of anything. So Allah, the Gentle and Merciful, commanded that something be given them. It is a kindness, a charity, and a mending of a broken heart.

He points to a story elsewhere in the Quran as the opposite. The owners of a garden swore to harvest it at dawn, whispering so that no poor person would come in (68:17-24). By morning the garden was gone.

This is a sharp piece of emotional intelligence. The ayah does not say: give to the needy in general. It says: give to those who are present. The pain of exclusion is sharpest when you are in the room. Watching wealth pass from hand to hand, close enough to see, wounds in a way that distant poverty does not.

The legal status of this command is discussed by scholars, and that belongs to them. The human lesson is plain. Whenever good fortune is shared out in front of others, look at the edges of the room. Someone there has been watching every hand.
